If I Failed a Breath Test, am I Automatically Guilty?

  • Ketone Particles: Many people, such as smokers and diabetics, have high ketone levels. Most breathalyzers misread ketone as ethanol.
  • Unabsorbed Alcohol: When people drink, the alcohol stops in the liver before it goes into the bloodstream. As a result, recent alcohol consumption shows up on breath tests but not blood tests.
